Welcome to the AI Earth Geoscience Cloud Platform. The AI Earth Geoscience Cloud Platform (the "Platform") provides cloud computing and analysis services for multi-source remote sensing earth observation data. Before you use the services provided by the Platform, you must read the following terms (the "Terms of Service"). By clicking "Agree", you acknowledge and accept these Terms of Service.
I. Scope of the agreement
1.1 This agreement is between you and the Platform regarding your use of the Platform's services. "The Platform" refers to the AI Earth Geoscience Cloud Platform and its affiliated operating entities. "User" refers to a user of the AI Earth Geoscience Cloud Platform service and is referred to as "you" in this agreement.
1.2 This agreement also includes the Legal Statement and Privacy Policy. When you use a specific service on the Platform, that service may have a separate agreement and related business rules (collectively, "Separate Agreements"). Once officially published, these documents become an integral part of this agreement, and you must comply with them. Your acceptance of any Separate Agreement constitutes your acceptance of this entire agreement. Your acceptance of this agreement also constitutes your acceptance of the Legal Statement and Privacy Policy.
II. Content provided by third parties
When you use products or services provided by third parties on the Platform, you must comply with the third-party user agreement in addition to this agreement. The Platform and the third party each assume their respective responsibilities for any disputes that may arise, within the scope permitted by law and their agreements.
III. User-sent content and complaint handling
3.1 You are solely responsible for the content, including but not limited to data, text, and images, that you send, upload, or transmit through this service.
3.2 The content you send or transmit must come from a legal source. You must own the content or have obtained the necessary authorization for it.
3.3 If the content you send or transmit is illegal, violates regulations, or infringes on the rights of others, the Platform has the right to independently review the content and take measures, such as deleting, blocking, or disabling links.
3.4 If you are the subject of a complaint or if you file a complaint against another user, the Platform has the right to provide necessary information, such as the identity, contact information, and complaint details of the parties involved, to the relevant parties or authorities. This facilitates the prompt resolution of disputes and protects the legal rights of all parties.
3.5 You warrant that the information, materials, and evidence you provide during the complaint process are true, legal, and valid.
IV. Platform data description
The map service data on the AI Earth Geoscience Cloud Platform is sourced from the National Platform for Common GeoSpatial Information, "Tianditu" (https://www.tianditu.gov.cn).
Public data on the AI Earth Geoscience Cloud Platform is sourced from the data copyright holders. The Platform complies with the usage agreements and regulations of the data copyright holders.
When you use data products to create publications, you must cite the source of the data products.
V. User data authorization
You understand and agree that by uploading, publishing, or transmitting content through this service, you represent that you have the right to do so. For the purpose of continuously improving this service, you grant the Platform and its affiliates a worldwide, perpetual, irrevocable, and royalty-free license to store, use, copy, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content. This license includes the right to incorporate all or part of the content into any other form of work, media, or technology. It also includes the right to commercially develop your uploaded and published content, provide related promotion and advertising services, and sublicense the foregoing rights to other third parties.
VI. User data sharing
Users can publish and share their own content, such as data and algorithms, on the Platform. When publishing and sharing content, you must ensure that the information is correct and complete, and promptly update it if it changes. If the Platform discovers that shared content violates these Terms of Service or any relevant laws or regulations, the Platform has the right to delete or block it without notifying the publisher. The Platform conducts a formal review of user-shared content. The user is responsible for the accuracy, completeness, legality, and authenticity of the information involved.
You must not use the resources and services provided by the Platform to share the following information or content. You must not provide any means for others to share such content, including but not limited to setting up URLs or banner links.
● Political propaganda or news information that violates national regulations.
● Information involving state secrets or security.
● Feudal superstitions, obscene, pornographic, or vulgar information, or information that incites crime.
● Illegal internet publishing activities, such as lotteries, gambling games, private servers, or game cheats.
● Information that violates national ethnic and religious policies.
● Information that jeopardizes the operational security of the Internet.
● Information that infringes on the legal rights and interests of others, or other information or content that is detrimental to social order, public security, or public morals.
● Other content that violates laws, regulations, departmental rules, or national policies.
VII. Disclaimer
7.1 The Platform's services are provided "as is" based on current technology and conditions. The Platform will use its best efforts to ensure the continuity and security of the services. However, the Platform cannot foresee and prevent all legal, technical, and other threats at all times. To the extent permitted by law, the Platform disclaims liability for such threats. These threats include but are not limited to service interruptions, data loss, and other losses and threats that may be caused by force majeure, viruses, Trojan horses, cyberattacks, system instability, third-party service defects, or government actions.
7.2 For content that you upload and share, you must ensure that the information is correct and complete, and promptly update it if it changes. The data you share must not contain any data that is prohibited from public sharing by law, such as data involving state secrets, national security, public interest, trade secrets, or personal privacy. If you violate this provision, you will be held personally liable, and the Platform will not assume any related legal liability.
7.3 The Platform requires that the data content you share undergo a quality inspection for accuracy, reasonableness, and scientific validity. However, the Platform makes no formal, express, or implied representations or warranties about the content. The Platform does not guarantee the exclusion of all possible erroneous data, because some data has not undergone quality control.
7.4 If the Platform discovers that a user has violated these Terms of Service or any relevant laws or regulations, it has the right to delete or block the content without notifying the publisher. The Platform only conducts a formal review of the service information registered by users. The user is responsible for the accuracy, completeness, legality, and authenticity of the data and information involved in any registered service.
7.5 You must comply with relevant local laws and regulations and respect local morals and customs while using this service. If your behavior violates local laws, regulations, or moral customs, you are solely responsible. You must avoid causing the Platform to violate laws or regulations or become involved in political and public events through your use of the service. Otherwise, the Platform has the right to suspend or terminate your service.
VIII. Limitation of liability
Unless otherwise stipulated by law, the Platform will not be liable for any direct, indirect, or punitive damages arising from your use of this service, even if you have been advised of the possibility of such damages.
IX. Limits
9.1 When using the Platform's services, you must strictly comply with national and local laws, regulations, industry practices, and public morals. You must not transmit or publish statements that incite resistance to or undermine the implementation of the constitution, laws, or administrative regulations. You must not transmit or publish statements that incite the subversion of state power, the overthrow of the socialist system, the division of the country, or the undermining of national unity. You must not transmit or publish statements that incite ethnic hatred, ethnic discrimination, or undermine ethnic unity. You must not interfere with the security and normal operation of the Internet and the Platform. You must not intrude into the Platform or the national computer information system. You must not transmit or publish any information or materials that are illegal, criminal, harassing, defamatory, insulting, intimidating, harmful, vulgar, obscene, violent, or uncivilized. You must not incite others to engage in the prohibited acts in this article, nor provide any convenience for others to use the Platform to publish, store, or transmit information that does not comply with national regulations or this agreement and other terms. You must not use any illegal means to obtain other users' personal information, use other users' information for any profit or non-profit purpose, or disclose the personal privacy of other users or rights holders. Otherwise, the Platform has the right to take reasonable measures as stipulated in this agreement and other terms to stop your behavior. In serious cases, criminal liability may be pursued.
9.2 When creating compiled works or derivative products, you must respect the intellectual property rights and related opinions of the data licensors. If you receive a notice from any licensor, you must, to the extent practicable, adjust the relevant information, annotation, and citation of the original author's identity and other information related to the original work as requested.
9.3 When distributing or publicly disseminating any compiled work or derivative product of the original work, you must retain all copyright notices from the original work in their entirety.
X. Agreement effectiveness and modification
10.1 Using this service, you signify that you have read and agree to be bound by this agreement.
10.2 The Platform has the right to modify the terms of this agreement when necessary. You can review the latest version of the agreement on the relevant service page.
10.3 If you continue to use the software or services provided by the Platform after the terms of this agreement are changed, you are deemed to have accepted the modified agreement.
XI. Service change, interruption, and termination
11.1 You understand and agree that the Platform may change the service content, or interrupt, suspend, or terminate the service due to adjustments in its business strategy.
11.2 In the event of a merger, division, acquisition, or asset transfer, the Platform may transfer the relevant assets under this service to a third party. The Platform may also, after notifying you, transfer some or all of the services and corresponding rights and obligations under this agreement to a third party for operation or performance. The specific transferee will be subject to the Platform's notification.
11.3 The Platform has the right to interrupt or terminate your service without notice if any of the following situations occur:
(1) You fail to submit true information as required by law, or the personal information you provide is untrue or inconsistent with the information provided at the time of registration and you fail to provide a reasonable explanation.
(2) You violate relevant laws and regulations or the terms of this agreement.
(3) As required by law or at the request of judicial authorities or other competent government departments.
(4) For security reasons or in other necessary circumstances.
11.4 You are responsible for backing up the data that you store in this service. If your service is terminated, the Platform has the right to permanently delete your data from the server, unless otherwise provided by law. After the service is suspended or terminated, the Platform has no obligation to provide or return your data to you.
XII. Governing law and jurisdiction
12.1 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement are all governed by the laws of the mainland of the People's Republic of China (excluding conflict of law rules). 12.2 This agreement is signed in Yuhang District, Hangzhou, Zhejiang Province, People's Republic of China.
12.3 If any term of this agreement is found to be invalid or unenforceable for any reason, the remaining terms will remain valid and binding on both parties.
12.4 If there are multiple language versions of this agreement, such as Chinese and English, and there is any inconsistency, the Chinese version will prevail.
