Mobile Push Terms of Service
These Terms of Service constitute a legally binding agreement between Alibaba Cloud Computing Co., Ltd. ("Alibaba Cloud") and you regarding the services provided by Alibaba Cloud.
By affixing your seal, clicking to accept on a web page, or otherwise indicating your acceptance of these Terms of Service—including but not limited to using Alibaba Cloud services without explicitly clicking to accept—you agree to be bound by all terms herein. If any discrepancy exists between a sealed paper version and an online or other accepted version of these Terms of Service, the sealed version shall prevail.
Please pay special attention to limitations, disclaimers, provisions regarding Alibaba Cloud’s determination and handling of your violations or breaches, and the choice of jurisdiction clause. These provisions may be highlighted in bold or underlined. Read these Terms of Service carefully before accepting them. If you have questions about any provision, contact Alibaba Cloud’s relevant business department for clarification. Do not proceed if you disagree with any part of these Terms of Service or cannot fully understand Alibaba Cloud’s explanation.
1. Service Description
In these Terms, "service" refers to the services displayed on Alibaba Cloud’s official website (www.aliyun.com), along with related technical and network support services.
2. Service Pricing and Fees
2.1. All service prices are listed on the pricing page of www.aliyun.com. Pay the applicable fees according to the current pricing structure on that site.
2.2. You may top up your Alibaba Cloud account via Alipay, online banking, bank transfer, or other methods (as displayed on the Alibaba Cloud website at the time of purchase). After topping up, you may purchase specific services. See announcements on the Alibaba Cloud website for detailed rules.
2.3. Depending on your service type, pay the service fee to Alibaba Cloud by the due date shown on the Alibaba Cloud website:
2.3.1. Pay-before-use:
If you purchase services sold on an annual, monthly, or resource plan (package) basis, Alibaba Cloud will provide the service only after you pay the full amount. If you do not pay immediately upon order confirmation on the website, you bear the consequences of order expiration: (1) orders unpaid for more than 7 days expire; (2) orders expire if the service is out of stock before payment. Upon expiration, all agreements or actions related to the order become void. To continue using the service after the current term ends, pay the renewal fee at least 7 days before expiration.
2.3.2. Use-before-pay:
If you purchase services sold on a pay-as-you-go basis, you may activate and use the service first. Alibaba Cloud will automatically calculate your actual usage from the previous billing cycle (hourly, daily, or monthly) and deduct the corresponding fee from your Alibaba Cloud account balance.
Specific billing rules and chargeable items are as published on the Alibaba Cloud website at the time of billing.
2.4. Maintain sufficient account balance to ensure uninterrupted service. Alibaba Cloud reserves the right to withhold service and/or technical support, or terminate service and/or support—including purging your data—until full payment is received. If you fail to pay on time, Alibaba Cloud may charge a late fee of 0.05% per day on the overdue amount, starting the day after the payment was due.
2.5. You fully understand that any promotional or complimentary services offered by Alibaba Cloud are one-time discounts beyond standard pricing. These offers do not include fees for modification, updates, or maintenance of the promotional services, and cannot be redeemed toward service fees.
3. Rights and Obligations
3.1. Your rights and obligations
3.1.1. Pay all applicable service fees as instructed on Alibaba Cloud’s website and as agreed in these Terms of Service.
3.1.2. You are solely responsible for the integrity and confidentiality of your data stored on Alibaba Cloud’s platform, along with your passwords and credentials used to access and manage Alibaba Cloud services. You bear all losses and consequences resulting from improper maintenance or disclosure of this information.
3.1.3. Provide Alibaba Cloud with the names, contact details, and necessary assistance for personnel responsible for executing these Terms and managing your network and cloud services. Update this information online promptly if changes occur and notify Alibaba Cloud. You are responsible for any consequences arising from inaccurate, incomplete, or false information, or from the actions or inactions of these personnel.
3.1.4. Do not install or use pirated software on Alibaba Cloud services or platforms. Alibaba Cloud may refuse to deploy applications that use pirated software. You assume full responsibility for results caused by your actions (such as installing software or performing operations). If a legitimate copyright holder files an infringement claim against Alibaba Cloud due to software you installed, take all reasonable steps to indemnify Alibaba Cloud—such as clarifying the situation or providing proof of legitimate software use—until the claim is withdrawn.
3.1.5. Retain access logs for your website as required by laws and regulations such as the Measures for the Administration of Internet Information Services. Logs must include published content, timestamps, IP addresses, and domain names. Cooperate fully if requested by authorized government agencies. You bear all legal liability for failing to retain required records.
3.1.6. You are responsible for the content of data stored on Alibaba Cloud’s platform. Alibaba Cloud advises you to carefully assess the legality of your data and monitor it accordingly. You bear all consequences and liability if your uploaded or stored content violates laws, regulations, or national policies. Alibaba Cloud system records may serve as evidence of such violations.
3.1.7. You understand and agree that state secrets of the People’s Republic of China are legally protected. You must comply with all applicable confidentiality laws when using Alibaba Cloud services and must not compromise the security of state secrets. Violations will result in legal action.
3.1.8. You agree to the following:
3.1.8.1. Obtain all required government licenses or approvals if your use of Alibaba Cloud services involves commercial or non-commercial activities requiring such authorization. This includes, but is not limited to:
(1) If you operate multiple websites, ensure all have valid government licenses or approvals;
(2) For non-commercial Internet information services, complete ICP filing with accurate and valid information, and update it promptly when changes occur;
(3) For commercial Internet information services, obtain a commercial website license from your local communications authority;
(4) For online gaming services, obtain a Network Culture Operation License;
(5) If you operate a website that provides online audio and video services, you are legally required to obtain a License for Online Transmission of Audio-Visual Programs.
(6) For news, publishing, education, healthcare, pharmaceuticals, or medical devices, obtain prior approval from relevant authorities before applying for licenses or completing filings.
You understand this list is not exhaustive. Ensure your activities comply with all current and future national and local laws and regulations.
3.1.8.2. Except as expressly permitted by Alibaba Cloud, do not modify, translate, adapt, rent, sublicense, publicly transmit, or transfer Alibaba Cloud software, or reverse engineer, decompile, or attempt to discover its source code;
3.1.8.3. Comply with all license agreements if Alibaba Cloud services involve third-party software;
3.1.8.4. Do not distribute email advertisements or spam: do not use Alibaba Cloud services to send large volumes of unsolicited or unwanted emails, electronic ads, or messages containing harmful content such as reactionary or pornographic material;
3.1.8.5. Do not use Alibaba Cloud services as an illegal proxy server;
3.1.8.6. Do not use Alibaba Cloud resources to upload, download, store, publish, or facilitate the publication (e.g., via URLs or banner links) of the following content:
(1) Political propaganda or news information violating national regulations;
(2) Information involving state secrets or national security;
(3) Content promoting superstition, obscenity, pornography, vulgarity, or criminal activity;
(4) Illegal online publishing activities such as gambling, prize games, private game servers ("private servers"), or cheating tools ("hacks");
(5) Content violating national ethnic or religious policies;
(6) Information compromising Internet operational security;
(7) Content infringing others’ rights or harming public order, safety, or morality;
(8) Any other content violating laws, regulations, or national policies.
3.1.8.7. Do not excessively consume or cause programs or processes to excessively consume computing resources (e.g., server memory, CPU, or network bandwidth) on Alibaba Cloud’s platform ("Cloud Platform"), thereby severely overloading Alibaba Cloud’s infrastructure or other users’ networks, servers (including domestic, international, or remote systems), or applications, disrupting connectivity between Alibaba Cloud and the Internet or internal systems, or causing service outages, system crashes, or application unavailability;
3.1.8.8. Do not perform or attempt any actions that compromise network security (including but not limited to phishing, hacking, online fraud, or distributing viruses, trojans, or malicious code; or using virtual servers to scan, sniff, perform ARP spoofing, or launch DDoS attacks against other sites or servers);
3.1.8.9. Do not alter or attempt to alter system configurations provided by Alibaba Cloud or compromise system security;
3.1.8.10. Do not use Alibaba Cloud services to harm Alibaba Cloud, its affiliates, or any company within the Alibaba Group (including but not limited to Alibaba, Taobao, Alipay, Alimama, and Ant Financial, collectively "Alibaba Companies"). Prohibited actions include violating any Alibaba Company service agreements, management rules, or transaction policies, or undermining fair trading environments or normal transaction order;
3.1.8.11. Do not engage in any other illegal, non-compliant, or prohibited activities under these Terms or Alibaba Cloud’s published management policies and procedures.
3.1.9. If Alibaba Cloud finds you in violation of these terms, it may take appropriate actions, including but not limited to immediately deleting content, suspending, or terminating service. If a third party files a complaint against you, Alibaba Cloud will notify you. You must respond within the specified time with an explanation and supporting documentation. If you fail to provide counter-evidence or respond on time, Alibaba Cloud may delete content, suspend, or terminate service. Failure to maintain accurate or updated contact information resulting in non-receipt of notice will be treated as untimely response.
3.2. Alibaba Cloud’s rights and obligations
3.2.1. Alibaba Cloud provides the services you ordered, in accordance with these Terms and commitments made on www.aliyun.com (e.g., Service Level Agreement (SLA)).
3.2.2. You acknowledge that Alibaba Cloud cannot guarantee its services will be flawless (for example, Alibaba Cloud security products cannot guarantee absolute security for your hardware or software), but Alibaba Cloud is committed to continuously improving the quality of its services. You agree that if the services have defects that are unavoidable given the current state of industry technology, this will not be considered a breach of contract by Alibaba Cloud. You agree to cooperate with Alibaba Cloud to resolve such defects.
3.2.3. Alibaba Cloud is responsible only for underlying components below the operating system and its own software—such as Elastic Compute Service (ECS), ApsaraDB RDS architecture, and operating systems. You are responsible for everything above the OS (e.g., applications you install). Upgrading your OS may cause downtime; assess risks carefully and proceed with caution.
3.2.4. Although some services may include data backup tools, these tools are not part of Alibaba Cloud’s core service offering. Alibaba Cloud is not responsible for your ability or inability to use them. You must handle data backups yourself and bear all related responsibility.
3.2.5. You understand Alibaba Cloud may impose limits on how you use services based on service characteristics or purchased specifications. Review Alibaba Cloud’s service documentation and comply with all usage limits. If you exceed your purchased capacity, Alibaba Cloud may restrict or suspend your service at its discretion.
3.2.6. Alibaba Cloud provides integrated security protection (e.g., "Cloud Security Server Guard") and monitoring features (e.g., "Cloud Monitor"). Despite thorough testing, compatibility with all hardware/software systems and error-free operation cannot be guaranteed. If issues arise, disable the affected feature or contact technical support.
3.2.7. During the service term, Alibaba Cloud provides the following customer support:
3.2.7.1. 7×24 post-sales fault support with clear contact channels and timely responses after fault identification;
3.2.7.2. 7×24 online ticketing system for usage-related inquiries.
3.2.8. Alibaba Cloud will resolve faults not caused by you, excluding those due to force majeure or factors beyond its control.
3.2.9. You understand Alibaba Cloud may migrate your ECS instances between data centers when necessary. Alibaba Cloud will notify you at least 7 calendar days in advance. Such migrations may require DNS updates for your domains. After receiving notice, update your DNS records to Alibaba Cloud’s designated IP within the specified timeframe. Failure to do so—and resulting website inaccessibility—is your responsibility.
3.2.10. During the term of these Terms, Alibaba Cloud may use your service usage as a case study or success story for promotional purposes, including using your company name and logo, provided no confidential information is disclosed. Alibaba Cloud will not otherwise use your name, logo, or branding without your written consent.
3.2.11. If these Terms are modified, Alibaba Cloud will announce changes on www.aliyun.com at least 30 days in advance. If you disagree with the changes, stop using the service, notify Alibaba Cloud to terminate service, and migrate your data. Alibaba Cloud will settle any outstanding fees. Continued use constitutes acceptance of the revised terms.
4. User Data
4.1. Alibaba Cloud recognizes that all business data you process using its services—including storage, upload, download, distribution, or other handling—is owned by you or other lawful rights holders. Alibaba Cloud will not use or disclose your data without authorization, except to fulfill your service requests or as follows:
4.1.1. When required by law, or by administrative or judicial authorities;
4.1.2. You and Alibaba Cloud have a separate agreement.
4.1.3. When necessary to deliver requested software or services, but only to the extent required, and only if the third party agrees to use the data solely for service delivery and maintain confidentiality at least equivalent to these Terms.
4.2. You understand that submitting mobile device IDs, device models, push certificates/channel configurations, message content, end-user accounts, aliases, and tags is essential for Alibaba Cloud to deliver accurate and complete Mobile Push services. This information enables precise targeting, delivery tracking, and audit logging. Alibaba Cloud strongly advises you to retain your own copies or backups, as it is not responsible for storing this data.
4.3. You understand and agree that, to ensure overall platform security, Alibaba Cloud monitors, inspects, and logs unsafe characteristics in your service usage and business data—but does not record or use the data content itself.
4.4. Unless required by law, regulatory authorities, or mutual agreement, Alibaba Cloud will retain user data for a limited period (typically no less than 72 hours) after service expiration, early termination, or suspension due to overdue payment. After this period, data will be destroyed, and you bear all resulting consequences.
5. Intellectual Property
5.1. You warrant that materials you submit and results generated using Alibaba Cloud services do not infringe third-party rights. If a third party claims infringement of copyright, rights, or violation of Chinese or applicable laws against Alibaba Cloud, you must indemnify Alibaba Cloud for all resulting costs or losses and hold it harmless.
5.2. If a third party challenges the intellectual property rights of materials used in your Alibaba Cloud services, you must provide proof of ownership and cooperate with Alibaba Cloud’s complaint resolution process.
5.3. You acknowledge that all materials, technology, support, software, and services provided by Alibaba Cloud are owned by Alibaba Cloud or third parties. Without explicit permission, you may not copy, distribute, transfer, license, or allow others to use these resources, and will be liable for any unauthorized use.
6. Confidentiality
6.1. "Confidential Information" means any business secret (including financial secrets), technical secret, trade secret, or other confidential information (e.g., product plans, pricing, financial/marketing strategies, business strategies, customer data, R&D, hardware/software specs, API data, technical documentation, formulas, algorithms) obtained by either party ("Recipient") from the other ("Discloser"), regardless of form, medium, or whether marked confidential at disclosure.
6.2. Both parties must protect Confidential Information with at least the same degree of care as their own confidential information, and use it only for purposes under these Terms.
6.3. Limit access to Confidential Information to employees and managers directly involved in this business, and ensure they comply with these confidentiality obligations.
6.4. The preceding restrictions do not apply in the following cases:
6.4.1. Was lawfully in the Recipient’s possession before or at the time of signing;
6.4.2. Was public or publicly available at the time of disclosure;
6.4.3. Was obtained from a third party without confidentiality obligations;
6.4.4. The confidential information is already publicly available through no breach of the obligations in these Terms of Service.
6.4.5. Was independently developed by the Recipient without using the Discloser’s information;
6.4.6. Must be disclosed pursuant to court or governmental order (via subpoena, investigation, etc.);
6.4.7. Must be submitted to regulatory bodies or industry associations to obtain certifications or comply with standards, provided disclosure is minimized and the receiving body agrees to confidentiality at least equivalent to these Terms.
6.5. Both parties must make best efforts to prevent unauthorized disclosure. In case of breach, cooperate to mitigate harm. The breaching party must compensate the other for direct economic losses.
6.6. This confidentiality clause survives termination of the service.
7. Service Activation, Modification, and Termination
7.1. You can activate and use the service through your Alibaba Cloud account or via API:
7.1.1. For services purchased on a yearly or monthly subscription basis or as a resource plan (package), the service is activated upon payment. After activation, you can use the service once you receive the required keys and security tokens from Alibaba Cloud to log on.
(1) For services with a yearly or monthly subscription, the service period begins upon activation, not when you obtain the key or security token to log on to or use the service, and ends when the subscription expires.
(2) Services sold as a resource plan must be used in their entirety within the specified service period. If the service period expires, any unused services are forfeited and Alibaba Cloud will not provide compensation.
(2) For resource plan services, use all units within the service term. Unused units expire at term end with no replacement or refund. The term starts at activation (not credential receipt). Usage consumes resource plan units first. If units are exhausted or the term expires and you haven’t renewed, Alibaba Cloud will treat further usage as pay-as-you-go (if available) and bill accordingly.
7.1.2. For pay-as-you-go services, use begins upon activation and continues unless terminated per these Terms or due to unpaid fees.
7.2. Alibaba Cloud continually improves service quality and may modify service forms, specifications, or features with reasonable advance notice.
7.3. Service terminates early under the following conditions:
7.3.1. Early termination by mutual agreement.
7.3.2. Your material breach (e.g., non-payment, serious legal violations, or breach of Section 3 commitments);
7.3.3. Despite Alibaba Cloud’s security measures (including ongoing improvements against viruses, intrusions, and attacks like DDoS), if your site suffers such an attack and harms Alibaba Cloud’s infrastructure or connectivity, Alibaba Cloud may suspend or terminate service. Refunds will be prorated by month (or day for partial months);
7.3.4. For technical upgrades, service adjustments, or business strategy changes, Alibaba Cloud may terminate service (or features) permanently or temporarily with 30 days’ notice via www.aliyun.com, in-site messages, or email. Refund any prepaid, unused amounts.
8. Liability for Breach
8.1. Either party breaching these Terms must bear legal liability.
8.2. The following do not constitute Alibaba Cloud breach:
8.2.1. Short service interruptions during server maintenance;
8.2.2. Slowed website access due to Internet congestion.
8.3. If Alibaba Cloud causes 72 consecutive hours of service unavailability (excluding factors beyond its control), you may terminate service.
8.4. In no event will Alibaba Cloud be liable for indirect, consequential, punitive, incidental, or special damages, including lost profits from using its services—even if advised of such possibility.
8.5. Alibaba Cloud’s total liability for breach under these Terms will not exceed the total fees paid for the affected service.
9. Force Majeure and Unexpected Events
9.1. Neither party is liable if performance becomes impossible, unnecessary, or meaningless due to force majeure or unexpected events.
9.2. Force majeure or unexpected events include unforeseeable, unavoidable, and insurmountable objective events significantly affecting one or both parties—such as natural disasters (floods, earthquakes, pandemics) or social events (war, civil unrest, government actions, telecom backbone failures, hacking, network congestion, telecom technical adjustments, or government regulation).
10. Governing Law and Dispute Resolution
10.1. These Terms are governed by the laws of the People’s Republic of China.
10.2. Resolve disputes through prompt negotiation. If unresolved, either party may file suit in the People’s Court where the defendant resides.
11. Miscellaneous
11.1. Service descriptions, pricing details, and your confirmed order pages on www.aliyun.com are integral parts of these Terms. In case of conflict, these Terms prevail.
11.2. Alibaba Cloud may transfer all or part of its rights and obligations under these Terms to an affiliate with 30 days’ notice via www.aliyun.com, in-site messages, or written notice.
11.3. Provisions that by nature should survive termination remain in effect—including but not limited to warranties, confidentiality, intellectual property, governing law, and dispute resolution clauses.
