If you receive a non-compliance notice, use this guide to correct your ICP filing or internet information service information.

Verification scope

To implement the requirements of laws, regulations, and rules such as the Counter-Terrorism Law of the People's Republic of China, the Cybersecurity Law of the People's Republic of China, the Measures for the Administration of Internet Information Services, and the Measures for the Administration of Filing of Non-commercial Internet Information Services, and to cooperate with the implementation of the Work Plan for Verifying the Authenticity of Website Filing Information (Trial) from the Ministry of Industry and Information Technology, Alibaba Cloud will conduct a special inspection of ICP filing information. This initiative aims to further standardize authenticity verification and ensure that existing filing information is authentic, accurate, and valid. The details are as follows:

Verification criteria

Verification content

Entity information

The entity name, certificate number, and registered address must match the entity's current, valid documents. The entity must be in good standing, and the ID document of the entity's principal must be valid.

Contact information

The contact information in the ICP filing, such as the primary contact (Contact 1) and emergency contact, must be authentic, valid, and reachable.

Domain name information

The filed domain name must be valid. The domain's real-name verification information must match the entity information. The domain registrar must be approved by the MIIT.

Access information

The IP address to which the filed domain name currently resolves must belong to the same access service provider listed in the ICP filing.

Service content

The content of the internet information service must match the ICP filing information and must not contain any prohibited content.

The following cases are considered a mismatch between the service content and the ICP filing information:

  • An individual uses their ICP filing to operate an enterprise internet information service.

  • The content of an enterprise's internet information service does not match the filed entity.

  • The service content requires pre-approval, but the required pre-approval has not been obtained.

Authenticity verification materials

Verification includes the ID documents of the entity principal and the internet information service principal, organization code certificate, business license, photo taken during on-site verification, and the verification form. The ID document of the internet information service principal must be valid.

Display of filing number

The ICP filing number must be correctly displayed at the bottom of the website's homepage or in a prominent location within the app. The number must link to the official MIIT filing website at https://beian.miit.gov.cn/.

During the special verification process, if Alibaba Cloud personnel find that your ICP filing information is non-compliant, you will be notified by phone, email, and SMS. Please ensure the phone number and email address in your ICP filing are correct and that you are reachable by Alibaba Cloud or your provincial communications administration.

Note

The outgoing numbers for Alibaba Cloud ICP filing calls are 0571-23675209, 0571-23675202, 0571-28950404, 0571-28950440, 0571-28958484, 0571-28959449, and 0571-28959494. These numbers cannot be called back directly. If you have questions about your ICP filing, please contact Alibaba Cloud online support.

After receiving a non-compliance notice, you must update your filing information according to the provided feedback and promptly resubmit it for review.

Non-compliance and fixes

Remediation

When you receive a notice from Alibaba Cloud about non-compliant ICP filing information, you must update your filing information or modify your service content before the deadline. Otherwise, the access for your ICP filing may be canceled or the ICP filing itself may be canceled, which will disrupt your website services.

  1. Log on: Log on to the Alibaba Cloud ICP Filing system.

    If you have forgotten which Alibaba Cloud account holds your ICP filing, see Retrieve Your ICP Filing Account.
  2. Identify the issue: In the Shutdown Risk section, find specific risk alerts and problem descriptions.

    If the risk and problem description for your ICP filing verification are not displayed, check your Message Center or the email address associated with your ICP filing for details.
  3. Start rectification: Follow the system prompts and recommendations to resolve the issues as soon as possible. After you complete the changes, Alibaba Cloud will re-evaluate your ICP filing information.

    Important

    When you submit your filing information, ensure it is authentic and accurate. Submitting false or inaccurate information can prevent you from completing the filing process and may damage your personal credit risk profile.


Scenario 1: Fix non-compliant information

This scenario applies if you received a rectification notice due to inaccurate information about your entity, principal, contact details, or website content.

Procedure:

  1. In the My ICP Filings list, find the filing entity or website/app with a Filing Status of "Risk".

  2. Based on the specific non-compliant information, click Change Entity or Change next to the item.

    • If the entity filing information is non-compliant: The Filing Entity section will show a Risk status. Click Change Entity to modify the ICP filing entity information.

      Important

      If the entity information is non-compliant and not corrected within the rectification period, or if it fails the re-evaluation, access for the entity and all associated websites or apps will be canceled, or the filings will be canceled.

    • If the internet information service filing is non-compliant: The corresponding website/app under Internet Information Service will show a Risk status. Click Change in the actions column to modify the ICP filing for the website or app.

    • If the internet information service content is non-compliant: See The internet information service content does not match the entity and update your service content as soon as possible.

  3. The system will guide you through the change ICP filing process. Follow the on-screen instructions to submit your latest, accurate information.


Scenario 2: Fix inaccurate access information

According to regulations, when your website or app uses Alibaba Cloud resources in the Chinese mainland, Alibaba Cloud acts as your network access service provider. We provide you with an ICP filing service code and report your access relationship to the filing authorities. Alibaba Cloud periodically checks whether the IP address for your filed domain points to our servers in the Chinese mainland to ensure access information is accurate. If you no longer use Alibaba Cloud as your access service provider, your actual access information will not match your filed access information. You must update or cancel your access information to remain compliant.

After receiving a verification notice, follow the process below. If you do not complete the rectification by the deadline, Alibaba Cloud will cancel access from its Chinese mainland nodes. If you have no other access service provider, the communications administration may cancel your filing number. To re-file, you must apply for a new ICP filing service code.

1. Verify your information

After receiving the notice, first decide if you want to continue using servers in the Chinese mainland:

  • If you have decided not to use servers in the Chinese mainland, no further action is required.

  • If you need to continue using servers in the Chinese mainland, ensure the domain for your filed website or app meets the following conditions:

    • The domain's DNS record points to an Alibaba Cloud server in the Chinese mainland (excluding China (Hong Kong)).

      If you use a third-party CDN or WAF with an origin server on Alibaba Cloud, ensure that the Host header for back-to-origin traffic is configured with the filed domain name.
    • There is genuine access traffic, and the traffic matches the DNS resolution.

If any of these conditions are not met, your filing will be flagged for inaccurate access information and will require rectification.

2. Rectify your information

If you need to use a server in the Chinese mainland, decide whether to keep your Alibaba Cloud ICP filing and take action accordingly:

  • If you want to keep your ICP filing with Alibaba Cloud

    You must point your filed domain name to an Alibaba Cloud server in the Chinese mainland and ensure it receives actual traffic.

    1. Ensure you have a server: If you do not have an Alibaba Cloud server in the Chinese mainland under your account, you can purchase an instance.

    2. Configure DNS resolution: Log on to your DNS console and add or modify the domain's A record to point to the public IP address of your server in the Chinese mainland.

      If you use Alibaba Cloud DNS, see Add a DNS Record or Modify a DNS Record. If you use another DNS provider, log on to their platform and point your domain to your Alibaba Cloud server.
    3. Ensure actual access: After setting up DNS, ensure there is genuine traffic to the domain and that the traffic matches the resolution.

      If you use a third-party CDN or WAF with an origin server on Alibaba Cloud, ensure that the Host header for back-to-origin traffic is configured with the filed domain name.
    4. (Optional) Clean up unused domains: If the verified website has domains you no longer use, submit a change ICP filing request to remove them.

  • If you no longer need your ICP filing with Alibaba Cloud

    • Case A: You migrated your website to another service provider (in the Chinese mainland) 

      First, complete a transfer-in ICP filing with your new service provider. After it is successful, submit a request to cancel access with Alibaba Cloud or wait for the system to process it automatically. After access is canceled, your domain will no longer be accessible through Alibaba Cloud servers, but this will not affect access through your new provider.

    • Case B: You shut down your website or migrated it to an overseas server

      If you moved your website or app to a cloud provider in China (Hong Kong), China (Macao), China (Taiwan), or another country or region, you can submit a request to cancel access, cancel ICP filing, or wait for the system to process it automatically.

After rectification, you can submit a request for manual re-evaluation or wait for the system to review it automatically. Once approved, the system will update the risk status.

Request re-evaluation or extension

During the rectification process, you can apply for an immediate re-evaluation or an extension to the rectification period.

  • Request an early re-evaluation

    • Purpose: Proactively request a re-evaluation from Alibaba Cloud after you have confirmed all rectification actions are complete.

    • Action: Log on to the Alibaba Cloud ICP Filing system. In the Website or App Shutdown Risk section, find the relevant issue and click Request Early Re-evaluation.

  • Apply for an extension: If you need more time to prepare materials, if the responsible person is traveling, or if you cannot complete the rectification on time for other reasons, you can check if an extension is available in the Alibaba Cloud ICP Filing system.

    • Purpose: Request more time to complete rectification due to special circumstances, such as needing to gather documents.

    • Action:

      1. Log on to the Alibaba Cloud ICP Filing system. In the Website or App Shutdown Risk section, click Apply for Extension.

      2. In the Apply for Extension dialog box, select a Delay time and a Reason for extension. Fill in the Details, and click OK.

      3. After the application is successful, the Apply for Extension button in My Filings will disappear.

    • Limitation: You can only apply for one extension per special verification rectification period. The maximum extension is 10 business days.

Appeal the verification result

If Alibaba Cloud restricts access to your internet information service because you missed the rectification deadline and you disagree with the result, you can appeal. For example, you can appeal if you believe your ICP filing information is correct, your website content matches your filing, or you have already submitted a change ICP filing request. Check the Alibaba Cloud ICP Filing system to see if you can appeal or request an early re-evaluation.

  • Action: Log on to the Alibaba Cloud ICP Filing system. In the Website or App Shutdown Risk section, click Online Appeal or Early Re-evaluation.

    • Online Appeal: In the Appeal dialog box, select a Reason for appeal, fill in the Details, and click OK.

    • Early Re-evaluation: In the Request Re-evaluation dialog box, fill in the Details and click OK.

    After you submit an Online Appeal or Request Re-evaluation, Alibaba Cloud may temporarily restore domain access until we provide a final conclusion.

  • Limitation: You can only submit one appeal per special verification rectification period.

Special case: No action taken

If you are temporarily unable to rectify the issue, and the Alibaba Cloud filing reviewer sends you a notice of no action after re-evaluation, a risk alert will still be displayed on your filing page for 30 days after the verification ends. It will include the following text: Please resolve the issues above as soon as possible. If not resolved in a timely manner, your filing information may be subject to another verification for the same issues in the future.

FAQ

Why a verification notice?

This notice means Alibaba Cloud found your filing information to be non-compliant during our special verification process. We then send a rectification notice via email and SMS. The notice details the issues with your current filing information and provides guidance on how to fix them. You should follow the guidance to rectify your information before the deadline.

Why is access information verified?

According to relevant policies and regulations, ICP filing information must be authentic and valid. The actual network access service provider for a website or app must match the information in the ICP filing. If you stop using Alibaba Cloud as your network access service provider, your actual access information will no longer match your filing, which violates regulatory requirements. The specific regulations are as follows:

  • Article 8 of the Administrative Measures for the Filing of Non-commercial Internet Information Services states that entities intending to provide non-commercial internet information services can delegate the filing, change, and cancellation procedures to their internet access service providers, internet data center operators, or other telecommunication service providers that provide access for their websites.

  • The Notice on the Filing of Mobile Internet Applications by the MIIT requires that app providers file with the provincial communications administration where they are domiciled. The network access service provider and app distribution platform process the filing online through the National Internet Basic Resources Management System.

  • Article 14 of the Administrative Measures for the Filing of Non-commercial Internet Information Services (Order No. 33 of the former Ministry of Information Industry) states that if a non-commercial internet service provider needs to change the information in its Filing Registration Form during the validity period, it must log on to the MIIT filing system 30 days in advance to update the filing with the original authority.

  • Article 15 of the Administrative Measures for the Filing of Non-commercial Internet Information Services (Order No. 33 of the former Ministry of Information Industry) states that if a non-commercial internet service provider needs to terminate its service during the validity period, it must log on to the MIIT filing system on the day of termination to cancel the filing with the original authority.

When your website or app uses Alibaba Cloud resources in the Chinese mainland, Alibaba Cloud acts as your access service provider and provides you with an ICP filing service code. We also report this access relationship to the filing authorities. If you stop using Alibaba Cloud as your access service provider, your actual access information will not match your filed access information. You must update or cancel your access information to remain compliant.

What if I do not update my information?

When you receive a notice that your filing information is non-compliant, you must rectify it within the specified period. Failure to do so has the following consequences:

  • During the rectification period:

    Your website services will continue to operate normally. Complete the rectification promptly. Your actions during this period will not affect your website services.

  • After the rectification period expires:

    If you have not successfully rectified your filing information by the deadline, Alibaba Cloud may cancel access for your filing, or the communications administration may cancel the filing entirely. This will disrupt your website services.

Update your filing information based on the feedback promptly. This will help you avoid issues such as being unable to continue with your filing or damaging your personal credit score due to false or inaccurate information. If your filing access is canceled or the filing itself is canceled, see transfer-in ICP filing or initial ICP filing for next steps.

What if the service is no longer used?

If you receive a rectification email but the entity or website associated with the filing number no longer exists or is no longer in use, log on to the Alibaba Cloud ICP Filing system to cancel the ICP filing. For detailed instructions, see cancel an ICP filing. If you do not rectify the issue before the deadline, Alibaba Cloud will cancel access for your filing.

Important

Currently, some domain name suffixes cannot be re-filed to point to servers in the Chinese mainland after the original filing has been canceled. For a list of domain suffixes that can be filed, see Domain name preparation and check.

What if access is canceled during rectification?

If your filing's access was canceled because you failed to complete the required changes by the deadline, follow these steps:

  1. Check if the website's filing information still exists with the MIIT. See How to query filing information.

    • If both the website and entity filings have been canceled, start a new ICP filing process.

    • If the website filing was canceled but the entity information still exists, you must cancel an ICP filing offline and then start a new ICP filing process.

    • If the entity information and other website filings still exist with the MIIT, proceed to the next check.

  2. Check if the mobile number of the internet information service principal is still in use.

    The principal's mobile number must be verified during the transfer-in ICP filing process. For details, see Step 3: Verify your mobile number via MIIT SMS.

    • If the number has changed or is no longer in use, but you have a filing with another access provider, you can change your filing with them. If you do not have another access provider, cancel an ICP filing offline and then start a new ICP filing process.

    • If the mobile number is still in use, proceed to the next check.

  3. Check the rules of the communications administration for your province in ICP filing rules of different regions. Determine whether your local authority allows you to perform a transfer-in ICP filing first and then change the filing information later.

    • If your province does not allow transferring first and changing later, cancel an ICP filing offline and then start a new ICP filing process.

    • If your province allows transferring first and changing later, and you still need to use Alibaba Cloud servers in the Chinese mainland, log on to the Alibaba Cloud ICP Filing system immediately. Abandon the pending change request and submit a new transfer-in ICP filing application. Once the transfer-in filing is successful, your website access will be restored.

      Important

      After the transfer-in ICP filing is successful, review the Alibaba Cloud ICP Filing Verification Notice email, check your information, and proceed to change ICP filing.

How to restore access if MIIT filing still exists?

1. Add access (with option to update information)
When you submit a request to add access, you can update your filing information (such as entity name or principal information) at the same time.

  • How to do it: Click Start ICP Filing and enter your latest information. The system automatically identifies this as a transfer-in ICP filing process.

  • Result: After the transfer-in ICP filing is successful, your website access will be restored.

2. Transfer in, then change (for multi-domain websites with some invalid domains)

  • Scenario description: You have multiple domains under one website filing number. Issues with some of these domains caused the access for the entire filing number to be canceled. To restore access for the valid domains, follow the rules of your local communications administration:

  • Guidance:

    • If the authority allows "transfer in, then change": First, submit an "Add access" request. After the transfer is approved, submit a "Change filing" request to remove the problematic domains.

    • If the authority does not allow "transfer in, then change": You must first cancel the website filing offline. After it is canceled, submit a new filing for the valid domains you want to keep using.

What if the MIIT filing is also canceled?

If your filing's access was canceled because you missed the deadline and took no further action, check the MIIT ICP Filing Management System. Search for your Entity Name to see if an entity record without any website information exists.
