What is a trademark registration application

Updated at:

A trademark registration application is the legal process for businesses to obtain exclusive rights to a trademark. A registered trademark is better protected under the Trademark Law. This topic describes trademark registration applications and trademark classification.

Trademark registration application

To obtain exclusive rights for a trademark on goods or services, an individual, legal entity, or organization must apply for registration with the Trademark Office. A trademark registration application can be for a goods and services trademark, an international trademark, a certification trademark, a collective trademark, or a special symbol registration. To register a trademark, see Smart trademark registration guide.

Trademark classification

  • Overview:

Trademark classification is based on the International Classification of Goods and Services for the Purposes of the Registration of Marks, also known as the Nice Classification. China joined the Nice Agreement in 1994 and uses its own Classification of Similar Goods and Services, or Trademark Classification Table. For the Trademark Classification Table, see Trademark Classification Query.

    Note

The International Classification of Goods and Services was established by the Nice Agreement of June 15, 1957. The Trademark Office periodically adjusts the trademark classification.

  • Classes and items:

There are 45 trademark classes. Classes 1 to 34 are for goods, and classes 35 to 45 are for services. Each class contains several items. When you register a trademark, select the classes and items for the goods or services you want to protect. You can apply for multiple classes and items for the same trademark. A service item is a specific project within a service class. You can view the specific classes and items on the Trademark Classification page.

  • Pricing:

Trademark registration fees are based on the number of classes you select and the number of items within each class. For more information, see Pricing.
